Terms of Service

These Terms of Service (“Terms”) govern your use of SepticNearby (the “Site”) operated by VoixWare, LLC (“we,” “us,” “our”). By accessing or using the Site, you agree to these Terms.

1) About the Site; No Professional Services

The Site is an informational and lead-generation platform that helps connect users with independent septic service providers. We are not a plumbing or septic contractor and do not provide field services. Any work is performed solely by independent third parties. We do not control, endorse, or guarantee any provider’s qualifications, pricing, availability, insurance, licensure, permits, or performance.

2) Eligibility; Your Responsibilities

You must be at least 18 and capable of entering a binding contract. You are responsible for your submissions, for verifying provider credentials and permits, and for decisions you make based on information from the Site.

3) Acceptable Use

• No unlawful, fraudulent, or abusive activity.
• No scraping, rate-limiting evasion, or security testing without consent.
• No posting or transmitting malicious code.
• No impersonation or infringement of others’ rights.

4) Content; Ownership; License

The Site and its content are owned by us or our licensors and protected by law. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes.

5) Telephony & Call Tracking

Phone numbers on the Site may be unique tracking numbers. When you place a call, we or our telephony providers may collect call metadata (e.g., time, duration, outcome) and, where permitted with notice, record calls for quality, training, analytics, and compliance. By using tracked numbers, you consent to such processing as described in our Privacy Policy.

6) Third-Party Providers & Links

The Site may display third-party content or link to third-party sites. We are not responsible for third-party websites, content, services, or practices. Your dealings with any provider are solely between you and that provider.

7) Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT INFORMATION IS CURRENT OR COMPLETE.

8) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY WILL NOT EXCEED USD $100.

9) Indemnification

You will defend, indemnify, and hold harmless VoixWare, LLC and its affiliates from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Site or breach of these Terms.

10) Compensation & Disclosures

We may receive compensation from affiliate, lead, or pay-per-call partners when you call a number, submit a form, or otherwise engage. Such compensation does not constitute our endorsement of any provider. See our Affiliate Disclosure.

11) Copyright/DMCA

If you believe content on the Site infringes your copyright, send a notice to our Copyright Agent at [email protected] with: identification of the work and material, your contact info, a statement of good-faith belief, and a statement under penalty of perjury that the information is accurate and you are the rightsholder or authorized agent. We may remove content at our discretion.

12) Governing Law; Arbitration; Class Action Waiver

These Terms are governed by the laws of the State of Wyoming and applicable U.S. federal law, without regard to conflict-of-laws rules. Any dispute will be resolved by binding arbitration on an individual basis under the Federal Arbitration Act and the Commercial Arbitration Rules of the American Arbitration Association (AAA). The seat of arbitration will be Wyoming, and the language will be English. Class or representative actions are not permitted. Either party may seek injunctive relief in court to protect IP or confidential information. You may opt out of arbitration by emailing [email protected] within 30 days of first agreeing to these Terms.

13) Suspension/Termination

We may suspend or terminate access to the Site at any time for any reason. Upon termination, provisions that by their nature should survive (e.g., ownership, disclaimers, limitations, arbitration) will survive.

14) Changes to Terms

We may update these Terms from time to time. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
