These Terms of Service ("Terms") govern your use of SepticNearby, a website operated by VoixWare, LLC ("we," "us," or "our"). By using the site, calling a listed number, or submitting an online request, you agree to these Terms.

1) What SepticNearby Is

SepticNearby is an informational and lead-routing website. We help users find or request contact with independent septic service providers. We are not a septic contractor, plumbing contractor, engineering firm, inspection company, emergency service, or government agency. We do not perform septic pumping, repair, inspection, installation, permitting, or field work.

2) Independent Providers

Any septic service provider you contact through the site is an independent third party. We do not control and do not guarantee any provider's licensing, insurance, bonding, availability, pricing, scheduling, workmanship, safety practices, permits, code compliance, or final result. You are responsible for verifying any provider before hiring them.

3) No Emergency Guarantee

The site is not an emergency dispatch service. Online requests and call routing may be delayed, unavailable, or unsuccessful. If you have an immediate health, safety, sewage backup, environmental, or property damage emergency, contact local emergency services, your local health department, a licensed septic professional, or other appropriate authority directly.

4) No Quote or Price Guarantee

Information on the site is for general planning and routing purposes. Unless explicitly stated in a written agreement with a provider, any pricing, service descriptions, availability, or timing information is non-binding. Final pricing and scope are between you and the provider.

5) Online Requests and Communications

When you submit an online request, you agree that we may process the information you provide and contact you about that request by your selected method, including call, text, or email. Message and data rates may apply for calls or texts. You also authorize us to share relevant request details with independent providers or operational vendors as described in our Privacy Policy.

6) Call Tracking and AI Intake

Phone numbers on the site may be tracking or routing numbers. Calls may be handled by telephony systems, AI receptionist flows, or other intake tools. Where enabled and legally permitted, calls may be recorded, transcribed, summarized, or logged for intake, quality, analytics, compliance, and provider routing.

7) Compensation Disclosure

We may receive compensation from providers, affiliate partners, pay-per-call networks, lead buyers, or similar partners when you call a number, submit a request, or connect with a provider. Compensation may affect placement, prominence, or availability of contact options. See our Affiliate Disclosure.

8) Your Responsibilities

• Provide accurate information when submitting a request.
• Do not submit false, abusive, unlawful, or misleading requests.
• Verify provider credentials, pricing, permits, insurance, and scope before authorizing work.
• Use the site only for lawful personal or business purposes related to septic service information or requests.

9) Acceptable Use

You may not scrape, attack, overload, reverse engineer, bypass security controls, interfere with site operations, submit spam, impersonate others, or use the site for unlawful or fraudulent purposes.

10) Intellectual Property

The site, design, text, data, software, and other content are owned by us or our licensors. We grant you a limited, revocable, non-exclusive license to access the site for its intended purpose. You may not copy, republish, sell, or exploit the site or its content except as allowed by law or with our written permission.

11) Disclaimer of Warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RELIABILITY.

12) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOIXWARE, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, PROPERTY DAMAGE, PERSONAL INJURY, SERVICE FAILURE, PROVIDER CONDUCT, OR DISPUTES BETWEEN YOU AND ANY THIRD PARTY ARISING FROM OR RELATED TO THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED USD $100.

13) Indemnification

You agree to defend, indemnify, and hold harmless VoixWare, LLC from claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising from your use of the site, your submissions, your violation of these Terms, or your dealings with any third-party provider.

14) Third-Party Links and Services

The site may link to third-party websites or services. We are not responsible for third-party content, policies, pricing, availability, or conduct.

15) Governing Law and Disputes

These Terms are governed by the laws of Wyoming and applicable federal law, without regard to conflict-of-law rules. Any dispute will be handled individually, not as a class action. Where permitted by law, disputes will be resolved in state or federal courts located in Wyoming, unless we both agree to another forum.

16) Changes to These Terms

We may update these Terms from time to time. Continued use of the site after changes are posted means you accept the updated Terms.
